An Enduring Power of Attorney (EPA) is a legal document that allows you to appoint a trusted person (your "attorney") to make decisions on your behalf if you become mentally incapable. Unlike a standard Power of Attorney, an EPA remains valid even if you lose mental capacity — making it a critical part of any estate plan.

The EPA Process

1. Choose your Attorney(s): Must be 18+, not your solicitor or care worker. Can be a spouse, child or trusted friend.
2. Consult Hugh Phelan Solicitor: We explain your options, draft the EPA document and ensure you understand what you are signing.
3. Signing & Registration: The EPA is signed by you, your attorney, and must be certified by a solicitor. It is then registered with the Decision Support Service.
4. Safe Storage: The registered EPA is kept safely. Your attorney can activate it if you become incapacitated.

EPA + Will — The Complete Estate Plan

Most solicitors recommend having both an EPA and a will as part of a complete estate plan. An EPA protects you during your lifetime if incapacitated; a will distributes your estate after death. Together, they give complete peace of mind.
